About Vendors Not Using Their Own Photos

The reason for this topic is that every year it is becoming more and more common. We want to make our customers and other gardeners aware of this growing problem. Also, you might not get what was advertised if they did not use their own pictures. So if they are not taking the time to take pictures and just taking them off the internet along with descriptions are the seed’s true. What are they doing when they are growing the plants also it makes me wonder. I do have to add about the bigger commercial seed companies. They do subcontract to breeder and gardeners. Where the breeders and gardeners take the pictures but supply the seeds along with the pictures of that variety to the bigger companies to sell. Those pictures and seeds are true because the breeder or grower made sure they were to be offered through a bigger commercial company. In this situation with the bigger companies, I wanted to make sure this was added, but this is not what the blog is about and some people would look at this situation as a gray area. Which I do not look at this as a gray area because the pictures are true to the seeds you the customer are purchasing, just there are more parties involved. But they have permission to use the photo along with the seeds that were purchased directly from the breeder/grower who grew the plants for seeds and took the photos.

Questions To Ask

Do you think it is alright to sell seeds on a site by using another person’s photos without their permission? I had to also ask my self why they would do this? What are they trying to hide? Is it fair to the person who originally took the photo? Is it fair to the consumer?

Reasons 
The reason I asked these questions is that before I list seeds for sale I compare it by my notes and pictures, if it doesn’t match I do not list it. An example of this is the cover photo for this blog did not match what it was supposed to be. So I could not list these tomatoes because they were not correct. While I was researching, I found a few sites using other photos that another person took, and you know they did not get permission to use them. Example how I caught this was I know they were Brad Gates photos and Bakers Creek photos on this site. I dug a little deeper and found some other sites too, and at least 3 quarters of it was of other people’s photos by researching them by image. But I noticed some of their own photos they did use the seeds they were selling are not true to what the variety. Now if you grew out the tomato for seeds to trade or sell, and it is not true, but it was supposed to be an heirloom tomato. Now, there are 2 different kinds of tomatoes out there with the same name, one is true and one is not.
My Opinion
Now that brings me to why I do not feel it’s right. Now if they are selling seeds using someone else’s photo I feel that kind of false advertisement for these reasons. First if they did not get permission to use the photo at least have respect to ask and just not take something. Also, what if it’s not the right kind of variety they have listed for that picture. Plus, the other way I look at this is if they have time to list the item for sale, they should find the time to take a photo and take pride in what they are selling.  Next, if they are selling the seeds and say for example they use a photo of mine. But someone buys seeds from the person that used my photo and their seeds did not come true the following year. That customer couldn’t remember where he/she got the seeds. Then sees that photo on my site, he/she might not purchase from me because they did not come true from the other person.
How We List Our Tomato Seeds
I take a lot of pride in what I do along with my family to bring you our customers the best grown true tomato seeds. I took over 9,000 pictures this year. We grew over 750 tomato plants organically and squeezed over 7,000 pounds (3.18 ton) for seeds in 2022. I take all the notes, compare everything at the end of the year write all the descriptions and list them all to make sure what we are selling is true and correct. Also, I want to describe what we are selling the best way possible by my notes I took during the summer and what other customers thought about these tomatoes from the farmers markets. This is a lot of work, but at the end of the season when everything gets listed, we know it is true and correct.

We will continue to offer the best quality true tomato seeds we possibly can to our customers. Along with getting your orders out as quick as possible to you. In 2022, we want to grow more varieties of tomatoes with the addition of more beans and isolated peppers to our gardens this year to bring more variety of seeds to you our customers. Also, will be regrowing older varieties to bring better pictures and better descriptions for 2022.
